TERMS OF USE AND CONDITIONS APPLICABLE TO THE USE OF “ESPACIO IBERIA” AND TO THE BOOKING AND PARTICIPATION IN ACTIVITIES WITHIN “ESPACIO IBERIA”

    1. PREAMBLE

    The website espacio.iberia.com (the “Website“) is the property of IBERIA LÍNEAS AÉREAS DE ESPAÑA, S.A. OPERADORA Sociedad Unipersonal, with registered office in Madrid (28027, 28027 Madrid, Spain), with registered office in Madrid (28027, Spain), Calle Martínez Villergas nº 49 and CIF (ES)A85850394 (“Iberia“) and its objective is to publicise the promotional action of Iberia’s products and services that will take place in the pop-up showroom that will be temporarily installed in the city of Madrid (C.P. 28001), at 37 Velázquez St. (the “Espacio Iberia“).

    These General Terms and Conditions (the “ Terms and Conditions“) are intended to regulate the use of the Website or its content, the browsing of users through the Website (the “Users“) as well as the registration that said Users carry out, through the Website or directly in Espacio Iberia, to participate in the different activities held or organised in the Espacio Iberia during the days and hours open to the public. Browsing the Website, registration for activities in Espacio Iberia, as well as visits to the Espacio Iberia and participation in the activities organised therein (whether or not they have been booked through the Website) by visitors to the Espacio Iberia (the “Visitors“) imply the acceptance and commitment by Users and Visitors to comply with the terms, instructions and obligations set out in these Terms and Conditions.

    As a general rule, the terms and conditions established for the use of the Website at https://www.iberia.com/es/legal-information/ shall also apply to Users when they use and browse the Website.

    In the event of contradiction or discrepancy between such terms and conditions and these Terms and Conditions, the latter shall prevail in the relationship between Iberia and Users and/or Visitors.

     

    1. USE OF THE WEBSITE

    You undertake to comply with the recommendations and instructions provided by Iberia in relation to the use of the Website.

    You must also undertake to use the conditions and contents of the Website in a diligent, correct and lawful manner and, in particular: (i) refrain from using the contents for purposes or effects contrary to law, morality and generally accepted good customs or public order; (ii) reproduce or copy, distribute, allow public access through any form of public communication; (iii) transform or modify the contents, unless you have the authorisation of the holder of the corresponding rights or this is legally permitted; (iv) use the contents and, in particular, information of any kind obtained through the Website for any other kind of commercial purpose.

    You agree that all Content on the Website is the property of Iberia, and that your acceptance of these Terms and Conditions or your use of the Website does not transfer to you any title to any of its content or any ownership rights therein, which are reserved in favour of Iberia in all cases. The content of the Website may not be used, sold, disclosed, licensed, provided or accessed for any other purpose that has not been expressly authorised by Iberia. Nor may you combine, associate, synthesise or reverse engineer the content of the Website without our consent.

    You shall comply with all our directions and instructions regarding your access to the content of the Website. You shall not copy, publish, disclose or make available to third parties the data and information contained therein in any unauthorised form or manner.

     

    1. ACCESS TO ESPACIO IBERIA. RIGHT OF ADMISSION

    Unless expressly stated otherwise, access to Espacio Iberia Area is free and open to Visitors.

    However, Iberia reserves the right of admission to Espacio Iberia, amongst other reasons and as non-exhaustive examples:

    • To comply with legally established capacity limitations.
    • For reasons or its own criteria regarding matters such as security, emergency, cleanliness, organisation, etc….
    • To prevent or prohibit entry to those persons who do not show civic, orderly or respectful behaviour towards other Visitors, Iberia staff, third parties, or the facilities, equipment or furnishings of Espacio Iberia; or when a person or group of persons may pose, in Iberia’s opinion, any kind of risk in this regard.
    • When it becomes apparent or it is suspected that a Visitor is or could be under the influence of any type of substance (alcohol, drugs, medication, etc.) that alters their perception or behaviour, or when a Visitor’s behaviour violates the regulations applicable to public or crowded spaces (for example, rules against the use or consumption of tobacco, vaping or other substances that are not permitted).

     

    1. AVAILABLE ACTIVITIES. BOOKING AND PARTICIPATING IN ACTIVITIES

    As it happens with access to Espacio Iberia, participation in the activities carried out therein (the “Activities“) shall be free of charge for Visitors unless expressly indicated otherwise.

    In view of this free nature, Users and Visitors waive the right to make any type of claim against Iberia in the event that, for whatever reason, the Website is not operational, or the use or performance of the Activities is not possible or is suspended for a more or less prolonged period of time.

    Visitors must use the activities of Espacio Iberia in a responsible, civic and respectful manner.

    Visitors wishing to take part in any of the Activities that require a reservation or prior appointment must make this reservation through the Website and/or the alternative channels determined in each case. In these cases, in order to benefit from the reservation made, Visitors must be present at Espacio Iberia premises and identify themselves enough in advance before the time they have booked to perform the Activity in question. Failure to show up on time may result in the loss of the right to participate, and Iberia may decide at its discretion that other people may take their place instead.

    For Activities that do not require a prior reservation or appointment, Visitors may use them in the order (either by order of arrival, by age group or affinity, or by any other criteria that may be determined at Iberia’s discretion) and according to the indications provided by the staff in charge at Espacio Iberia at any given time.

     

    1. IMPORTANT ALLERGEN WARNING

    Activities at Espacio Iberia may include food and/or beverage tastings. IF ANY VISITOR IS ALLERGIC OR INTOLERANT TO ANY TYPE OF FOOD OR SUBSTANCE, THEY MUST MAKE THIS KNOWN TO OUR STAFF BEFORE CARRYING OUT THE ACTIVITY so that we can check and inform them accordingly so that the Visitor can assess, where appropriate, whether or not there is a risk to their health by participating in said Activity.

    If your allergy or intolerance is of an ENVIRONMENTAL TYPE, please consult our staff BEFORE ENTERING ESPACIO IBERIA. Thank you very much.

     

    1. PROCESSING OF PERSONAL DATA – DATA PROTECTION POLICY

     

    The data that you provide as your own when you request a reservation for any of the Activities of Espacio Iberia will be used by Iberia for the sole purpose of processing and respecting the reservation you have made -including sending the necessary communications for this purpose- and will not be used for any other purpose or stored for any other purpose.

     

    When you provide us with your data in these cases, you are guaranteeing: i) that you are the owner of the contact data provided (email address, telephone number, if applicable), or that you have the necessary permissions for Iberia to use them to contact you through them; and ii) that said data are correct, complete and true.

     

    To the extent they may be applicable, we will apply the same principles to the processing of the data you provide to us as are set out in our Personal Data Protection Policy available at https://www.iberia.com/es/privacy-information/, and you will therefore also enjoy the same rights.     1. MISCELLANEOUS. GOVERNING LAW AND COMPETENT JURISDICTION

     

    The headings of the various sections of these Terms and Conditions are for information purposes only and shall not affect, qualify or extend the interpretation of the terms and conditions which they encompass.

     

    In the event that any provision or provisions of these Terms and Conditions shall be held to be invalid or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions.

     

    The failure of Iberia to exercise or enforce any right or provision contained in these Terms and Conditions shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by Iberia.

     

    These Terms and Conditions shall be interpreted in accordance with common Spanish legislation in all matters not expressly regulated herein, and in accordance with the terms and conditions established for the use of the Website.

     

    For the resolution of any discrepancy related to our relationship with you arising from the interpretation or execution of these General Conditions or the use of the Private Area, the Spanish courts and tribunals shall have jurisdiction, with preference given to those of Madrid (Spain).
